Trademarks

  • Trademarks not registered in mainland China face the risk of being preemptively registered
  • Exhibits bearing unregistered but used trademarks should be displayed cautiously to avoid trademark infringement disputes. It is advisable to apply for registration in advance

Copyright

  • Copyright arising from computer software, web pages, and packaging designs related to exhibition products should be properly licensed. Especially for packaging or designs purchased from third parties, it is necessary to confirm whether the third party has the right to license. For OEM situations, the ownership of relevant intellectual property should be clarified
  • Pay attention to the legal use of copyrighted materials; design files, etc., need to obtain authorization to avoid infringement

Patents

  • Apply for patent protection in China for products to prevent competitors from filing first. Note the differences between utility model and design patents

Key Points of Measures for the Protection of Intellectual Property at Exhibitions

  • These measures have been effective since March 1, 2006, and apply to the protection of intellectual property in various economic and technological trade exhibitions, fairs, expositions, trade fairs, and displays held within Chinese territory
  • Exhibition organizers shall legally protect the legitimate rights and interests of intellectual property owners, sign intellectual property protection clauses with exhibitors, and designate special personnel to be responsible for intellectual property protection work
  • Exhibition organizers shall set up an intellectual property complaint agency during the exhibition to accept complaints from intellectual property owners and handle them promptly in accordance with the law

  • Formulate and strictly implement exhibition intellectual property protection rules, and set up service desks at the exhibition venue to provide consulting services
  • Sign intellectual property protection agreements with exhibitors, clarifying the rights and obligations of both parties
  • Strengthen inspection and supervision during the exhibition to detect and handle intellectual property infringement in a timely manner

Self-Protection Recommendations for Exhibitors

  • Before the exhibition, conduct a comprehensive intellectual property review of exhibits and related materials to ensure no infringement of others' intellectual property
  • Prepare relevant intellectual property certification documents, such as patent certificates, trademark registration certificates, copyright registration certificates, etc.
  • Once infringement is discovered, promptly file a complaint with the exhibition organizer and provide relevant evidence materials
  • Display intellectual property protection signs on the booth to remind visitors to respect intellectual property

List of Materials Required for Complaints

If you discover suspected infringement at the exhibition venue and need to file a complaint with us, please prepare the following documents:

  • Complaint letter (stating the complainant's name, address, contact information, as well as the respondent's booth number and specific details of the suspected infringement)
  • Complainant's identity documents and power of attorney (if applicable), as well as relevant intellectual property right certificates (copies)
  • Physical objects or photos of the suspected infringing exhibits or materials, as well as other evidence proving infringement
  • Trademarks: Trademark registration certificates and relevant change certificates (if any), as well as trademark usage authorization letters (if any)
  • Patents: Patent certificates and relevant documents, including patent evaluation reports (if any), utility model patent search reports, design patent brief descriptions, etc.
